Muslim Scholars Issue Fatwa Declaring No Conflict Between Islamic Law And U.S. Constitution

Islamic scholars tired of conservative charges that Muslims in the United States constitute a radical fifth column bent on subverting American values and obligated by their religion to launch jihadist terror attacks are fighting back by issuing a fatwa.

The Islamic religious ruling, a “Resolution On Being Faithful Muslims and Loyal Americans,” is a response to what its authors call “erroneous perceptions and Islamophobic propaganda” that has built up for a decade following the 9/11 attacks and subsequent terrorist plots by adherents of al-Qaida and other extremist groups. It was issued in Virginia late last month by the Fiqh Council of North America (FCNA), a group of Islamic scholars who meet several times a year to draft opinions on issues of concern to American Muslims.

“As a body of Islamic scholars, we the members of FCNA believe that it is false and misleading to suggest that there is a contradiction between being faithful Muslims committed to God (Allah) and being loyal American citizens,” the fatwa declared.

“Islamic teachings require respect of the laws of the land where Muslims live as minorities, including the Constitution and the Bill of Rights, so long as there is no conflict with Muslims’ obligation for obedience to God. We do not see any such conflict with the U.S. Constitution and Bill of Rights. The primacy of obedience to God is a commonly held position of many practicing Jews and Christians as well.”

Muslims make up less than 1 percent of the nation, according to the Pew Forum on Religion & Public Life, yet the fast-growing community has been a constant target of right-wing groups. From protests against the so-called “ground zero mosque,” to efforts in more than a dozen states to ban Sharia lawin courts, to recent Capitol Hill hearings on Islamic radicalization that brought comparisons to McCarthyism, Muslims have had to assert their loyalty.

And that troubles members of the Los Angeles Police Department, who in recent years have been at the forefront in building bridges to the Muslims in order to combat radicalization and enlist the community in the fight against terrorism.

Los Angeles Police Chief Charlie Beck and other law enforcement officials will attend a meeting Thursday at the Islamic Center of Reseda to talk about the new fatwa as part of his department’s Muslim Community Forum. Muzammil Siddiqi, director of religious affairs of The Islamic Society of Orange County and the president of the Fiqh Council of North America, will be on hand to discuss the origins of the fatwa.

For many non-Muslims, perhaps the best-known fatwa was the one against authorSalman Rushdie for his book “The Satanic Verses.” Iran’s Ayatollah Ruhollah Khomeini declared it blasphemous and called for Rushdie’s death.

This new decree might face a warmer welcome.

“We’re always fighting two sides of extremism. There’s the violent ideological side and the neo-conservative side that is creating hate campaigns against American Muslims …which is a bunch of BS,” said Michael Downing, commander of the LAPD’s Counter Terrorism and Criminal Intelligence Bureau. “The majority of American Muslims are as patriotic as you and I. This declaration says it is not a conflict to be a faithful Muslim and loyal American.”

    Read between the lines, primary obedience is to islamic law, sharia and anything the imam says, after that they may or may not embrace the law of the land as long as it does not interfere with their oppression of females and hatred of Jews and Gays.

    Have a look at the Cairo Declaration of Human Rights and the differences between it and The Universal Declaration of Human Rights. That’s another tip off, everything in the Cairo document is “subject to the islamic shariah”.

  2. Lets see here all the members of this council are on the banned scholars list by the Islamic Thinkers Society. Here is what they have to say about them.

    This individual is a member of the Fiqh Council of North America. The FCNA is a batil fatwa committie formed of members who are unqualified to be a “Faqih” or Jurist. Just because some have Phd. and masters in Islamic studies, does not make them a faqih much less forming a committe of fatwa givers. Never in the history of Islam did such a committee exist which is based on a fringe understanding of Islam as this commitee has. If one were to observe the issues their fatwas address, one can see their apologetic responses to the masters of the West without being Islamically critical. These fatwas are to make Muslims submissive and coerce them to stop the global support for Islamic Revival. These two reasons(unqalified and moderate agenda) are sufficient which makes them an invalid Islamic fatwa committiee hence it should be ignored by the Muslim communities of North America when a fatwa is issed by them.     Ok, So according to this group of American Islamists this group has no right to issue a Fatwa. So what are peoples thoughts.

    You seem to be confused between Muslims and their Imam and Christians and the Pope. It is a held belief that the Pope is free of mistakes. In Islam we are encouraged to openly crticize and correct the Imam. During prayer, if the Imam makes a mistake when reciting the Quran, the learned Muslim in the back is obligated to correct him. As usual, you seem to take Muslims as being the only people who oppress gays, jews, and females. Pamella Geller still feeding you this garbage? The Quran does not give Muslims permission to kill gays. It does not oppress women and Muslims don’t hate Jews. Or are you just going to quote extremists overseas who think otherwise? How about quoting all those verses of the Quran Robert Spencer feeds you? Why? Oh, that’s right. You luv taking verses of the Quran out of context and u will continue to do so until someone else can openly expose Pamella Geller for her lies. It is already happening and she will most definitely go the same way McCarthy did.

  5. Ignore Anonymous, (s)he’s just a bit low on the reading comprehension or selectively mis-quoting by purposefully taking the first half of a statement (“Respect… if no conflict”) and ignoring the second half (“We do not see any such conflict”).

    To anyone with a modest level of reading comprehension this is no more disturbing than “If I have milk, I’ll eat cereal. I have milk!”.

  6. I see the taqiyya and double speak appear to be in fine form in the two posters above. It appears one of them only believes the Meccan koran and nothing after that, you know the part where all the peaceful verses have been abrogated and violent verses have taken their pace the other is “unaware” of the duality that islam thrives upon.

  7. I would just like a comment from the people on this forum stating if this group of scholars has the authority to issue a Fatwa that Muslims respect. Every man on that list has a problem with them according to a group of American Muslims. These issues can be read about on the Islamic Thinkers Society website.

    “It is a held belief that the Pope is free of mistakes.” i think you are taking the concept of “infalliblity” out of context. but it is a scary concept when religious people believe they talk to god or angels. or when they claim to know “divine writ” or “god’s law”.


    as for conflict between sahria and the constitution. how can you not see a conflict when sharia demands the stoning of adulterers? any american court worth it’s salt would rule that as cruel and unusual punishment.

    oh yeah us fornicators need to be careful too. don’t these scholars think whipping people is cruel? guess not? how about freedom of speech and “blashpemy laws”. how about the killing/stoning of apostates and freedom of religion?

    how about inheritance laws? sharia is sexist by definition, woman gets half as much as the man, and in total conflict with current american law?
